§ 1 Scope, provider

These terms and conditions apply to all orders placed by consumers and businesses through the online sale (buy button / Shopify checkout) on www.espresso-tonic.com with

(the "Provider"). Any deviating terms of the customer shall not become part of the contract unless the Provider expressly agrees to their application in writing.

§ 2 Formation of contract

The presentation of products on the website does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button (the payment-obligating order button in the checkout), you submit a binding offer to purchase the goods in your cart. The contract is concluded when the Provider accepts the order by an order confirmation by email or delivers the goods.

§ 3 Pre-order / delivery time

The online sale of the 24-can tray is a pre-order: payment is made immediately on ordering, delivery of the first batch is expected from early August 2026, once it has been filled. If the expected delivery date is delayed, the Provider will inform the customer in good time by email. In the event of a significant delay, the customer may withdraw from the contract; payments already made will then be refunded without undue delay. The statutory right of withdrawal (see § 7) remains unaffected.

§ 4 Prices and shipping costs

All prices are in euros and include statutory VAT. The 24-can tray costs €48.00 (equivalent to €2.00 per 250 ml can, i.e. €8.00/l). In addition there is €10.00 shipping per order and €6.00 DPG one-way deposit (24 × €0.25). The deposit is refunded at any reverse-vending machine in Germany. The total costs are shown separately before the order is completed in the checkout. Delivery is within Germany only.

§ 5 Payment

Payment is processed via Shopify's payment service provider. The payment methods shown in the checkout are available (e.g. credit card, PayPal, Klarna). The purchase price is due immediately upon conclusion of the contract.

§ 6 Delivery, retention of title

Delivery is by parcel service to the delivery address provided by the customer within Germany. The goods remain the property of the Provider until full payment has been made.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. The full right-of-withdrawal notice including the model withdrawal form is available separately and forms part of these terms.

§ 8 Warranty

Statutory warranty rights apply. In the event of defects in the delivered goods, please contact us using the details above.

§ 9 Dispute resolution

The European Commission's online dispute resolution (ODR) platform was discontinued on 20 July 2025. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory consumer-protection provisions of the country in which the consumer has their habitual residence. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
